Produce LLC ("we," "us," "our") respects your privacy. This Privacy Policy explains how we collect, use, and protect your personal information when you use the Tomato app ("App").

1. Information We Collect

• Account Information: Name, email address, and password when you create an account.
• Health Profile: Health goals, health conditions, diet preferences, food allergies, gender, birth year, height, weight, activity level, and goal weight that you provide during onboarding or in your settings.
• Chat Messages & Photos:Text messages and food photos you send through the App's chat feature.
• Wellness Logs: Entries related to meals, water intake, and exercise.
• Device & Usage Data: Device type, IP address, crash reports, and analytics data. We also use third-party SDKs that may collect identifiers and app interaction data for analytics, product improvement, and—if you opt in—advertising measurement (see Sections 4 and 5).

2. How We Use Information

We use your data to:

• Provide and improve the App's features.
• Generate personalized health, nutrition, and fitness recommendations using AI technology (see Section 4 for details on third-party AI processing).
• Send reminders, updates, or service-related notifications.
• Conduct analytics and troubleshoot performance.
• Measure the effectiveness of marketing and advertising, understand how people discover the App, and attribute installs and conversions (such as completing onboarding or starting a subscription trial) when you use supported features and, where applicable, after you opt in to tracking on iOS.

3. Wellness Data Disclaimer

The information you log in the App may relate to your diet, hydration, or exercise. This information is not medical data and is not protected under HIPAA unless specifically noted. The App is intended for general wellness only.

4. Sharing of Information

We do not sell your personal information.

We may share data with:

• OpenAI: To provide personalized recommendations, we send the following data to OpenAI for processing:
  • Health goals and health conditions
  • Diet preferences and food allergies
  • Gender, birth year, height, and weight
  • Activity level and goal weight
  • Chat messages and food photos

  OpenAI processes this data solely to generate responses within the App and does not use your data to train its models. You can review OpenAI's data handling practices at openai.com/enterprise-privacy.

• Google (Firebase):We use Google's Firebase services (such as Firebase Analytics and Firebase Remote Config) to understand how the App is used, improve stability and features, and deliver remote configuration. Firebase may collect device and usage information subject to Google's policies. See Firebase Privacy Information and Google's Privacy Policy.
• Meta (Facebook):We integrate Meta's software development kit to send app events (for example, when you complete onboarding or start a subscription trial) for measurement, analytics, and advertising attribution. Meta may process identifiers and event data in accordance with its terms and may use Apple's SKAdNetwork for privacy-preserving attribution. See Meta's Privacy Policy.
• Service providers that help us operate the App (for example, hosting and infrastructure).
• Legal requirements: We may disclose information when required by law, regulation, legal process, or governmental request, or to protect our rights, safety, or property.

Before your data is shared with OpenAI, we obtain your explicit consent within the App. You may contact us at any time to withdraw consent or request deletion of your data.

5. App Tracking & Your Choices (iOS)

On supported versions of Apple's iOS, we may ask for permission to track your activity across other companies' apps and websites for advertising measurement purposes (Apple's App Tracking Transparency prompt). If you decline, we will not access your device's advertising identifier for that purpose through the prompt, though limited measurement may still occur using privacy-preserving technologies such as SKAdNetwork. You can change your choice later in Settings > Privacy & Security > Tracking on your device.

6. Data Security

We use encryption, secure storage, and access controls to safeguard your data. However, no system is completely secure, and we cannot guarantee absolute protection.

7. Your Rights

Depending on your location, you may have rights to:

• Access, update, or delete your information.
• Request a copy of your data.
• Opt out of certain data uses.

8. Children's Privacy

The App is not intended for children under 13. We do not knowingly collect information from children. If we learn we have collected information from a child under 13, we will delete it promptly.

9. Changes to This Policy

We may update this Privacy Policy from time to time. Updates will be reflected in the "Effective Date" and, if material, we will notify you via the App or by email.
